Summons Publication Riverside County
When a defendant cannot be served personally after reasonable diligence, California Code of Civil Procedure §415.50 allows service by publication in a newspaper of general circulation. The court must first grant an order authorizing publication (Judicial Council form SUM-200). Summons must then be published once a week for four consecutive weeks.
Summons by Publication — Requirements
- Court must first grant an Order for Publication (CCP §415.50(b))
- The newspaper must be a paper of general circulation most likely to give actual notice
- Publication runs weekly for four consecutive weeks (CCP §415.50(c))
- Service is complete on the 28th day after the first publication
- Proof of Publication must be filed with the court
